- Are your spill prevention strategies and storage and handling requirements all in place and in order?
When we first think about the aspects of spills,
- What can result and the relevant Compliance aspects. A spill risk assessment should be conducted to assist with your response planning.
The Environment Protection Act (general environment duty) states…
A person must not undertake any activity that pollutes, or might pollute, the environment unless the person takes all reasonable and practicable measures to prevent or minimise resulting environmental harm”
Deliberate or negligent pollution results in prosecution and fines. So that person is YOU, even as an employee - must not cause pollution.
Taking “all reasonable and practicable measures” means following the instruction for correct storage and handling of chemicals and the company/organisation procedures and being trained and competent to clean up spills using the spill equipment.
No-one intended for this to happen...
A small contained spill, a burst hose or pump failure. A truck or loco rollover, an oil or chemical spill into a water course or river, a major environmental hazard with huge impact...
Once pollution enters your Stormwater Drains and leaves your property, you are still responsible for the effects!
The EPA can track pollution back to the source – So ensure you have a made every effort to prevent that pollution and have demonstrated Due Diligence and Defense, with drain signage, the right response resources and trained personnel

Prosecutions and Penalties
Prosecution is an important part of environmental law enforcement. The Environmental Protection Agency (EPA) encourages individuals and businesses to integrate good environmental practices into normal working methods and seeks to prevent environmental pollution before it has a chance to occur. In some cases, non-compliance with the legislation is dealt with by the imposition of a penalty. Payment of the penalty will avoid further court proceedings for that specific non-compliance.
